We refer to Section 13.6 of LSH Capital’s Prospectus dated 28 February 2025 (“Prospectus”) as well as the updates in relation to the Litigation provided vide the Company’s quarterly reports, the latest of which being the quarterly report for the financial period ended 31 December 2025 issued on 25 February 2026 (“Q1 2026 Report”) on the above matter. Unless otherwise defined, the terms herein shall bear the same meaning as defined in the Prospectus and the Q1 2026 Report.

The Board wishes to announce that pursuant to a Court of Appeal decision on 26 February 2026, the execution of the Court of Appeal’s earlier decision in requiring the Respondents to provide certain categories of documents sought by the Applicants (“COA Decision”) has been stayed pending the conclusion of the following:-

(i) Datuk Bandar’s motion for leave to appeal to the Federal Court against the COA Decision (“Datuk Bandar’s Motion for Leave to Appeal”); and

(ii) subject to the Datuk Bandar’s Motion for Leave to Appeal being granted, Datuk Bandar’s subsequent appeal to the Federal Court.

(collectively known as “COA Stay Decision”).

Notwithstanding the above, pending the courts’ decision on the Judicial Review Application, ASES is permitted to continue works on the Lake Side Homes Project pursuant to the Impugned Development Order and Impugned Bridge Approval from 21 August 2024 onwards.
