Further to the latest announcement dated 5 May 2026 ("Announcement") and subsequent updates disclosed in the latest quarterly reports released on 16 April 2026 ("Disclosure"), unless otherwise defined, the definitions and terms used as set out in the Announcements and Disclosures shall apply herein.
The Board of Directors of the Fund wishes to announce that further to the case management for the Fund's application for leave to appeal against the Court of Appeal decision in Federal Court Civil Application No. 08(f)-126-03/2026(W) and Federal Court Civil Application No. 08(f)-129-03/2026(W) ("Motions"), the Court had indicated that the Motions shall be heard together.
The Court has fixed the hearing on 27 August 2026 and instructed the following:
- To file a supplemental affidavit exhibiting the Notes of Evidence of the Court of Appeal; and
- To file the Written Submissions, Bundle of Authorities, Common Core Bundle, Executive Summary on or before 12 August 2026.
The next case management has been fixed on 13 August 2026 to monitor the above.
The Fund will make further announcement on the developments of the above matter as and when is necessary.
