We refer to the announcements dated 19 September 2016, 26 September 2016 and 4 October 2016 on the winding up of the Company.

The Liquidators wish to update shareholders that the High Court of Malaya at Kuala Lumpur (Commercial Division) (“High Court”) had on 10 October 2016 granted an order for the following, amongst others:

1. the Liquidators be at liberty to appoint a team of professionals (“Professionals”) to assist the Liquidators in the discharge of their duties;

2. subject to the High Court’s approval, the Liquidators to appoint any other party whom the Liquidators deem fit to assist the Liquidators and/or whom the Liquidators deem fit to replace any of the Professionals; and

3. the Liquidators be permitted:

• to effect an interim distribution to eligible shareholders based on the record of depositors at Bursa Malaysia Depository Sdn Bhd as at 29 September 2016 and as confirmed by the High Court (“Eligible Shareholders”) in respect of 97% of the monies transferred from the cash trust account operated by Deutsche Trustees Malaysia Berhad to a bank account opened and operated by the Liquidators as trustee (“Cash Trust Account”);

• to retain the remaining 3% of the monies in the Cash Trust Account (“Retention Sum”) pending final distribution (if any) to the Eligible Shareholders;

• to effect payment of all taxes payable and direct expenses related to the liquidation from the Retention Sum including the costs and expenses incurred by the Company in relation to the liquidation of Sona Exploration & Production (Thailand) Ltd, Sona Goldhill Sdn Bhd and Sona E&P (Perth) Pty Ltd; and

• to effect final distribution of the remaining Retention Sum (if any) to the Eligible Shareholders upon completion of the liquidation, after deducting all taxes payable and direct expenses related to the liquidation and after obtaining tax clearance.
