Reference is made to the announcement made on 10 June 2024 by ATA IMS Berhad (“ATAIMS” or “the Company”) relating to the (ex-parte) Interlocutory Injunction obtained by its wholly owned subsidiary ATA Industrial (M) Sdn Bhd (“Plaintiff” or “AIM”) against Shinano Kenshi Co. Ltd. (“Defendant” or “Shinano”) from the Johor Bahru High Court, and in connection with this injunction, the Originating Summons number JA-24NCC-19-06/2024.

The Board of Directors wish to announce that the Defendant’s solicitors had issued a letter to AIM’s lawyers dated 11 June 2024 to inform that they have withdrawn the statutory demand dated 16 May 2024, and have undertaken not to file any winding up petition based on the said statutory demand.

During the case management held on 12 June 2024, the Plaintiff has correspondingly withdrawn the said Originating Summons, with liberty to file afresh. As such, the injunction proceedings fixed on 20 June 2024 for inter parte hearing of the injunction has also been withdrawn.

The above marks the end of legal proceedings relating to the originating summons and interlocutory injunction.
